PhotoDynamic Inc. Privacy Policy
This Privacy Policy describes how we collect, use, and disclose personal information when you interact with PhotoDynamic, such as when you visit our website, or use our services, whether as a dental or orthodontic care provider (a “Clinical Care Provider”) using the PhytoLight Portal (the “Portal”), or as an end user (a “Patient”) of the PhytoLight device (the “Device”) and the mobile app (the “App”).
Please take a moment to read the following to learn more about our information privacy practices, including the types of information we collect, how we use information that we collect and for what purposes, to whom we disclose the information, your choices about how your information is shared, and how we safeguard your personal information. Your privacy is a priority at PhotoDynamic, and we go to great lengths to protect it.
What is “personal information”?
In this Privacy Policy, “personal information” means information about an identifiable individual, where the individual can be identified from the information or the identity of the individual can reasonably be inferred from the information when combined with other information that is available to PhotoDynamic. “Personal information” does not include information that is anonymized or information in aggregate form.
What information we collect
If you are a Clinical Care Provider using the Portal, we collect certain information from you directly so that you can create a Portal account, including your name, email address, and the corporate name and address of your clinic or practice. We also collect from you the serial numbers associated with each Device that you provide to a Patient under your care. We do not collect any Patient information from you.
If you are a Patient, we collect personal information from you in order to open an account on the App, including your name, email address, and the serial number of your Device. Your Device collects information relating to your use of the Device (“Usage Data”), which is then sent via Bluetooth to the App, such as how many days in a row you have used the Device, and if you used the Device as directed (for example, whether or not the Device is used for the recommended amount of time per use). You can decide if and how Usage Data is shared via the App through a menu on the App (you can decide if you would like to share Usage Data with your orthodontist or dentist, or with your parents, if you are under the age of 19), which is explained in more detail, below under Disclosure of your Personal Information. We do not collect, store or have access to your Usage Data.
If you make a purchase through the App or Portal, we collect information about the transaction generally, but we do not collect or store your credit card or other payment information (this is done through payment processor Stripe). For example, we would collect and use your name, shipping address and the details of your order in order to fulfil your purchase.
If you visit our website and fill in the contact form, we collect your email address and name, as well as any other information you include in a message to us (by sending a message to info@photo-dynamic.com). Information that you send to us via this means would be used to respond to your query.
When you visit our website, access the Portal, or download, access, and use the App, we may automatically collect:

Usage details. When you access and use the Portal or App, we may automatically collect certain details of your access to and use of the Portal or App, including traffic data, logs, and other communication data and the resources that you access and use on or through the Portal or App.

Mobile or other device information. We may collect information about your mobile device and internet connection, including the device's unique device identifier, IP address, operating system, browser type, mobile network information, and the device's telephone number.
The technologies we use for this automatic data collection may include:

Cookies (or mobile cookies). A cookie is a small file placed on your smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your device. However, if you select this setting you may be unable to access certain parts of the Portal or our App.
How we use Personal Information
In addition to the uses outlined above, we also use personal information as follows:

To provide you with the Portal, the App and its contents.

To provide you with information, products or services that you request from us.

To fulfill the purposes for which you provided it or that were described when it was collected or any other purpose for which you provide it.

To carry out our obligations and enforce our rights in any contracts with you, including for billing and collection or to comply with legal requirements.

To notify you when Portal and/or App updates are available, and of changes to any products or services we offer or provide though it.

To improve our Portal, App, products or services, or customer relationships and experiences.

To address any warranty issues or to process any recalls.

For any other reasonable purpose, with your consent.
Disclosure of your Personal Information
PhotoDynamic takes your privacy very seriously. We will never give, rent or sell your Personal Information nor use it for purposes other than for those that you have expressly consented, unless we are compelled to do so by law or in the event of a sale of any part of PhotoDynamic’s business operation. We do use non-identifiable or aggregate data for a range of purposes, including improving our services.
If you are a Patient, you can choose to share Usage Data with your Clinical Care Provider, to allow them to track your progress. PhotoDynamic does not have access to your Usage Data, or any other personal information that you might input (in addition to the information needed to open your account). In the App, there is a menu that allows you to choose who you will share the information with. While your Clinical Care Provider may not be granted permission by you to view Usage Data, your Clinical Care Provider knows which Device is yours by virtue of the serial number of the Device. As a Patient you can also choose to share your Usage Data with your parents or guardians.
We may disclose your personal information without notice or consent if we are legally obligated to do so, such as in response to a court order or production order. If we do so, we will endeavour to notify you in advance unless we are legally prevented from doing so.
Transferring your personal information
We may transfer personal information that we collect or that you provide us to contractors, service providers, and other third parties we use to support the Portal and App (such as analytics providers that assist us with improvement and optimization) and who are contractually obligated to keep personal information confidential, to use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy.

We may process, store, and transfer your personal information in and to other countries. Whenever we engage a service provider, we require that its privacy and security standards comply with this policy and applicable Canadian laws.

Protection of your personal information
The security of your personal information is very important to us. We use physical, electronic, and administrative measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We use Amazon cloud storage for all information we collect.

The safety and security of your information also depends on you. Where we have given you (or you have chosen) a password for access to certain parts of our Portal or App, you are responsible for keeping it confidential. We ask you not to share your password with anyone.
Unfortunately, the transmission of information via the Internet and mobile platforms is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the Portal or App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any Portal or App privacy settings or security measures.
Retention of personal information
Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize or aggregate your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.
Accuracy of and access to your personal information
It is important that your personal information accurate, complete, and up to date for the purposes for which it is used. You always have the right to access and correct the personal information you have provided, either directly through the Portal or App, or by contacting us at info@photo-dynamic.com and requesting any required changes. You also have the right to access the personal information we hold about you at any time, by sending a request via email to info@photo-dynamic.com. Whether you would like us to correct/update your information or provide you with access to or a copy of your personal information, we may ask you to provide additional information to verify your identity. We will only use this additional information for the purpose of identity verification and will not retain that information.
Children under the age of 13
If you are under the age of 13, your parent or guardian must set up your account through the App, and must review this Privacy Policy and consent to the collection, use and disclosure of your personal information. If we learn we have collected or received personal information from a child under 13 without verification of parental or guardian consent, we will delete that information. If you are a parent or guardian who believes that your child has submitted personal information to us and would like to have it deleted, please contact us at info@photo-dynamic.com.
Withdrawing your consent
Where you have provided your consent to the collection, use, and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances. To withdraw your consent, if applicable, contact us at info@photo-dynamic.com. Please note that if you withdraw your consent we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you make your decision.
